Terms and Conditions
This page sets out the terms and conditions the client must agree to when working with Bookollective. They are designed to make the process of working together fair and reasonable for both provider and client. Bookollective may change these terms from time to time by updating this page. You should check this page to ensure that you are happy with any changes. This policy is effective from 06.05.2020
During the period of the agreed period, the client contracts Bookollective to organise promotion and publicity for their Book through publicity, blog tours or social media campaigns. Throughout the agreement period Bookollective will take all reasonable steps consistent with the client's requests, which both parties agree are promotionally advantageous.
Throughout the agreement period it is understood that the client will remain in control of all matters relating to the marketing of their book. Bookollective shall not have the authority to bind or commit to any particular agreement, arrangement, association or programme or any amendment thereof without specific consents thereto.
Bookollective cannot guarantee media coverage, social media/blog coverage, or sales, but will endeavour to work with both the publisher and author to achieve the best possible results for their project.
The Agreement shall relate to the United Kingdom, Ireland the Channel Islands and the Isle of Man and any other territory, which the parties may agree in writing.
Once full payment is received, Bookollective will grant the client exclusive license of the final cover design. We will provide the design in JPEG, PNG and PDF where required. The client agrees that they have no right to alter the completed design in any way without informing Bookollective. Bookollective will not provide the client with indesign source files.
Every client must abide by the terms of the license agreement for the images used in the cover design, which have been purchased by Bookollective for use in the design. The cost of cover design includes the license to use these images and is limited to a print run of 250,000 units and e-book of 500,000 units. If necessary, this limit can be extended for an additional fee. It is the client’s responsibility to inform Bookollective if this is the case. It is the clients responsibility to request and include image copyright information within their book where necessary.
A client may supply their own images but they must meet specifications required. Bookollective has the right to see your license agreement.
No items such as cups, bookmarks, t-shirts, pens etc. made with the finished book design may be sold. These items may be given away for promotional purposes only.
DESIGN CLIENT RESPONSIBILITIES
It is the client’s responsibility to order a proof copy of their cover design from their printer before putting their book on sale. In the case of any problems or expenses incurred by the client in relation to using the cover design, Bookollective will take no financial or legal responsibility for this.
Any imagery, logos or elements provided by the client for use within a cover design are the clients' responsibilty. This includes obtainging the correct license and copyright for use on the cover design and any financial or legal implications on failure to do so correctly.
DOMAIN NAME RIGHTS AND RESPONSIBILITIES
We advise all clients to register their own domain name. Any domain names we hold for the client can be transferred to them upon request at any point when requested in writing via email to firstname.lastname@example.org. As a business asset to the client, it is the responsibility of the client to make a record of its renewal date and make the necessary arrangements with us or elsewhere. We will not be held responsible for any losses or late renewals.
EDITING LIMITATIONS OF LIABILITY
Bookollective provide editing suggestions and advice in good faith and to improve documents according to our experience. We aim to eliminate as many errors from your document as possible. However, we advise that you re-check all documents carefully before publication. If you have any doubts about the content or legality of your publication (for example, issues to do with libel, slander, plagiarism, copyright infringement, due credit), Bookollective recommend that you raise this with an appropriate organisation, and/or seek legal advice. Bookollective are not responsible for the content or legality of your publication.
If any content of your manuscript or other materials encourages or condones any practices that are illegal in the UK, Bookollective reserve the right to cancel and delete all materials relating to the matter. This includes but it is not limited to content that promotes racism, homophobia, incites hatred or encourages or promotes fraudulent activity.
Bookollective is a UK based company so please allow for time differences, we try to reply within 48 hours to all communications, but over busy periods this maybe longer.
Payment agreements are exclusive to each individual. Bookollective takes payments via Paypal.com and Direct Bank Transfer. Client will pay any additional bank charges if they occur.
Bookollective makes no warranties of any kind, express or implied, for any and all products and/or services it supplies. Bookollective will not be held responsible for any and all damages resulting from products and/or services it supplies. Bookollective is not responsible for any loss, or consequential loss of data, or non-delivery of products or services, of whatever cause where reasonable measures have been taken. While we take reasonable steps to investigate the materials we recommend, we accept no responsibility for the performance or quality of materials or any consequential loss arising from their failure. The customer agrees not to hold Bookollective responsible for any such loss or damage. Any claim against Bookollective shall be limited to the relevant fee(s) paid by the customer.
These Terms and Conditions supersede any previous Terms and Conditions distributed in any form. Bookollective reserves the right to change any rates and any of the Terms and Conditions at any time and without prior notice. Bookollective can refuse to work with anyone or stop work with a client at any time.
RELATIONSHIP BETWEEN BOOKOLLECTIVE/CLIENT
Nothing herein shall constitute a partnership joint venture or fiduciary relationship between Bookollective, the one part, or any client on the other and both parties will agree not to act as, or hold themselves out as, agents of the other.
All the information that a client shares with us is considered confidential, and will only be used by Bookollective to provide our best services, and to complete the service requested. We will not share this information with any third party, unless requested to do so by our client or is necessary to provide part of a service.
